EU Representative Service: Shepherd and Wedderburn

Posted: 7th December 2020

From 1 January 2021, when the Brexit transition period comes to an end, UK-based data controllers and processors offering goods or services to citizens in the European Economic Area (EEA) will need to have an EU Representative in place.

To assist clients in meeting this requirement, Shepherd and Wedderburn offer a fixed-fee European Representative service through its Irish subsidiary, Saltire Data Protection Services Limited, based in Dublin.

What is an EU Representative?

The EU Representative is appointed principally to communicate on privacy related matters with European supervisory authorities and data subjects. This is mandatory under GDPR for most UK-based data controllers and processors offering goods or services to EU citizens, or tracking their behaviour.

Do I need an EU representative?

Not every organisation needs an EU representative, for example public authorities/bodies are exempt. However, your organisation needs to appoint an EU Representative if  it has no offices, branches or other establishments in an EU country and it is offering goods or services to individuals in the EU or monitoring the behaviour of individuals in the EU.

In addition if your organisation is based outside the EU but currently uses a UK-based entity as its EU Representative then it will need to appoint a new EU Representative based in an EU Member State.

Download the Shepherd and Wedderburn brochure for more details.

Arrange a consultation today to discuss your requirement in more detail.
