Successful judgement in UK supreme court for BTO
Leading independent Scottish law firm BTO Solicitors LLP has been successful in an eagerly awaited judgment handed down this morning by the United Kingdom Supreme Court in the case of Dooneen Ltd t/a McGinness Associates –v- Mond.
This is the second time that BTO has appeared in the UK Supreme Court in 2018.
In this case, led by partner Dorothy Hatfield, ably assisted by Associate Kirsteen Maclean, BTO acted for the Respondents Dooneen Ltd t/a McGinness Associates. The case involved entitlement to a successful PPI claim where there had been an intervening insolvency by virtue of a Trust Deed. The issue for the Court was whether the Trust Deed had been brought to an end by the Trustee making a final distribution to creditors with the result that the PPI claimant (as opposed to his former Trustee) was held to be entitled to the PPI payment.
